SMS and Messaging Limitations

This policy explains important limits that apply to Catchwise SMS, missed-call, text inquiry, and auto-response features where those features are enabled.
1. SMS and messaging feature limits
Catchwise may support SMS/text inquiry capture and automatic SMS responses where enabled. These features are dependent on third-party providers, phone carriers, messaging registration, A2P/10DLC approval, customer configuration, consent requirements, and applicable provider and carrier rules, including but not limited to the TCPA, CTIA guidelines, Do Not Call rules, applicable state communications laws, and CAN-SPAM where email messaging or commercial email is implicated. Catchwise messaging is intended for limited inquiry-response and lead-response workflows, not for broad marketing campaigns unless approved by Catchwise in writing. SMS/text and auto-response features are not guaranteed to be available for every account, number, message type, or recipient.
Catchwise may delay, limit, disable, pause, or decline to enable messaging features if: A2P/10DLC registration or carrier approval is incomplete, denied, delayed, or changed; required business or campaign information is missing; a message type is not approved; a recipient has opted out or withdrawn consent; the use case may violate applicable law, carrier rules, Twilio policies, provider policies, or Catchwise policies; messaging creates deliverability, spam, fraud, abuse, compliance, legal, reputational, or platform risk; or provider or carrier filtering, outages, rate limits, or restrictions affect delivery. Carriers and providers may block, filter, delay, or reject messages even when Catchwise and the customer comply with all requirements. Gating, review, or approval of a messaging feature by Catchwise does not mean Catchwise has approved the legality of the customer's full campaign, and Catchwise does not provide legal or compliance advice on messaging campaigns.
Customers bear the sole and exclusive responsibility for ensuring they possess the legal right and necessary consent to text, call, or otherwise respond to leads and customers. Customers are responsible for maintaining proof of consent, including the source, date, method, disclosure language, and scope of consent. Customers must strictly comply with all applicable laws regarding opt-outs, honor opt-outs across all channels and understand that Catchwise opt-out handling may prevent future messaging. Catchwise expressly disclaims any guarantee regarding SMS delivery, carrier acceptance, response delivery, message timing, or the successful capture or transmission of every text inquiry or missed-call response. Catchwise must not be used for emergency, medical, financial, debt collection, regulated goods/services, political, adult, illegal, or high-risk campaigns unless specifically approved and lawful.
2. Short operational summary
SMS and auto-response features depend on Twilio, phone carriers, and A2P/10DLC approval. Catchwise may keep these features limited or unavailable until compliance approval is obtained. Delivery is not guaranteed, and customers are solely responsible for obtaining required consent, maintaining proof of consent, and honoring opt-outs.
